Information That You Provide To Us Voluntarily

For example, if you submit a sales inquiry our Site’s web form or request additional information or contact from Activu via email, you will provide us with certain Personal Information, which may include names, company name, address, and email address.

In addition, if you choose to communicate with us via a web form, email, or by telephone, we will keep a copy of our communication together with your email address or phone number and our responses.

 

Information That We Collect Automatically

Device-related Information. When you visit our Site, we may also collect device related information from the user’s device, including information such as an IP address, device type, unique device identification numbers, browser-type, broad geographic location (e.g. country or city-level location), the date and time of use of our Site, the date and time of an event on the client’s IT systems, system logs, and technical attributes about the device or a web browser. This information enables us to better understand use of our Site. To Serve Our Customer. We use the information we collect, including Personal Information, to provide our Services to the customer on whose behalf we are acting. For example, in order to provide technical support, we may contact a user (such as employees or staff members) of Activu’s clients using any contact information provided to us.

To Serve You. We use the information we collect, including Personal Information, to respond to any request or query directed to us (for example through web forms or email), to provide you/your organization with our products and services and to manage our relationship with you. For example, we may respond to a job application, address any inquiries or complaints you may have, endeavor to improve the services we provide, or provide you with information about other products and services we offer that we think you may be interested in.

For Direct Marketing. If we have the right to do so, we will use your Personal Information for the purposes of direct marketing communications to your organization, such as by adding your contact and other details to a marketing database. Where we do, we will provide you with an opportunity to opt out.

For Internal and Service-Related Purposes.We may use any information we collect through the services and/or our Site for internal and service-related purposes, including providing it to third parties as necessary to allow us to facilitate provision of the services, maintain or improve Site security, and/or invoicing for example.

Merger, Sale, or Other Asset Transfers. If we are involved in a merger, acquisition, financing, reorganization, bankruptcy, receivership, sale of company assets, or transition of service to another provider, information collected through our Site may be sold or transferred as part of such a transaction, as permitted by law and/or contract.

Other than as stated in this Privacy Notice, we will not release Personal Information to unaffiliated third parties.

 

Access, Integrity, Retention, and Choices

Access & Correction

If you wish to request access to, correction, or deletion of Personal Information you have submitted through our Site, you can contact Activu at marketing@activu.com. If you are a resident in the European Union, you may have additional rights which we have set out below.

 

Data Integrity and Purpose Limitation

Activu will use Personal Information only for the purpose of or in ways compatible with the purposes for which it was collected.

 

Information Retention

We keep information we need to provide our services only so long as we have a valid business purpose, in accordance with applicable law and our client agreements. For example, to provide you with services you have requested or to comply with applicable legal, tax or accounting requirements.

When we have no ongoing legitimate business need to process your Personal Information, we will delete it. If immediate deletion is not possible (for example, because your Personal Information has been stored in backup archives), then we will securely store your Personal Information and isolate it from any further processing until deletion is possible or unless as otherwise required by law.

 

User Choices

We include an “unsubscribe” hyperlink in Activu marketing emails for those users who wish to stop receiving email communication from Activu. The hyperlink will connect to our Site, which will confirm the email address that has been automatically unsubscribed and will no longer receive emails from Activu.

 

Security

We take steps to ensure that information is treated securely and in accordance with this Privacy Notice which include appropriate technical and organisational measures. These measures are designed to provide a level of security appropriate to the risk of processing of your Personal Information. However, neither the Internet nor any form of electronic storage can be guaranteed to be 100% secure, and we cannot ensure or warrant the security of any information provided to us.

 

Information Collected on Third Party Sites

If you register for events or webinars provided by us, we may receive information about you from the service providers that host or process registration for these programs or that provide other services to support these programs (such as technical support). By registering for or attending our events or webinars, you specifically consent to the receipt of these e-mail or text message communications. If you do not want to receive emails, text messages or other communications from us, please notify us by email. We may use that information to communicate with you about new or existing products and services or special offers. For example, we may periodically send promotional materials or notifications related to our products and services to the email address you provided during registration. You may unsubscribe to any of our e-mail updates by following the unsubscribe instructions in the body of any message, or by contacting us.

 

Disclosure of Information to Third Parties

We may disclose information from or concerning you or your computer or device to third parties such as third party advertisers and ad networks, providers of analytics tools, and event sponsors. By visiting, accessing, attending or using our website, services or events, you consent to the disclosure of your information to third parties for this purpose. This Privacy Policy does not apply to the policies or practices of any of these third parties.

 

Browser Do Not Track Signals

Some third-party browsers provide “do not track,” machine-readable signals for websites and online services that are automatically applied by default. Please note that we do not currently respond to browsers’ do not track requests. We have no control over the information sent from your browser to third parties such as ad networks and analytics companies. We recommend that you check your browser settings to prevent the disclosure of information you would not like to share.

 

Legal Matters; Safety

We may, without your consent, access and disclose your information, any communications sent or received by you, and any other information that we may have about you or your account as may be permitted or required by law (including, but not limited to, court order or subpoena), or to prevent or investigate suspected fraud, violations of our Terms of Service, which we encourage you to read in conjunction with this Privacy Policy, or activity that appears to us to be illegal or may expose us to legal liability. Additionally, we may disclose your information in situations that we believe may involve potential threats to the physical safety of any person or property.

If we or an affiliated company or brand or business are sold or disposed of as a going concern, whether by merger, sale of assets or otherwise, or in the event of an insolvency, bankruptcy or receivership, personal information of our users may be one of the assets sold or merged in connection with that transaction. Use and disclosure of information we obtain is subject to the later of: (1) the Privacy Policy in effect at the time such  information is collected or (2) any subsequent Privacy Policy of which you have notice. If we make material changes to the way we collect, use or disclose Personally Identifying Information, we will notify you by posting a clear and prominent announcement on our site or through a direct communication. Your continued access to or use of out site following notice of material changes to this Privacy Policy shall constitute consent to any amendments and/or modifications.
